Use of the SITE as defined below (including access, browsing, and the purchase of available products and services) constitutes an implicit agreement to comply with the terms and conditions set forth in this document, as well as with the policies and information displayed on the SITE, including special terms and conditions, with all the effects and consequences arising therefrom.
The website www.heroes.com is an e-commerce site that offers personalized and non-personalized gifts for sale via the Internet.

HDD Heroes is an industry-focused platform created to connect, support and promote people and businesses within the Horizontal Directional Drilling (HDD) industry.
Our activities may include:
industry networking;
company and supplier listings;
the HDD Heroes Partner Directory;
business introductions;
equipment and supplier connections;
industry-related marketing and advertising;
promotional opportunities;
competitions and giveaways;
selling merchandise;
custom-made merchandise;

2. Use of the Website
You agree to use the website lawfully and responsibly.
You may not:
use the website for fraudulent, unlawful or abusive purposes;
deliberately provide false or misleading information;
interfere with the security or operation of the website;

Unless specifically agreed otherwise in writing, information made available through the website does not constitute professional engineering, technical, financial, legal, safety or operational advice.
Horizontal Directional Drilling operations may involve significant technical, commercial and safety risks.
Users remain responsible for independently checking information and obtaining appropriate professional advice before relying upon or acting on information obtained through HDD Heroes.
4. Partner Directory
HDD Heroes may provide a directory of contractors, suppliers, consultants, manufacturers, equipment providers and other HDD-related companies.
A listing in the Partner Directory does not constitute a guarantee by HDD Heroes regarding:
workmanship;
qualifications;
financial standing;
product quality;
availability;
pricing;
safety;
regulatory compliance; or
suitability for a particular project.
Users must carry out their own checks and due diligence before entering into any agreement with a listed company.
Some listings may be sponsored, paid or provided as part of a commercial partnership.
5. Business Introductions
HDD Heroes may introduce users to suppliers, contractors, consultants, equipment providers or other third parties.
Unless specifically agreed otherwise in writing, HDD Heroes acts only as an introducer.
Any subsequent contract, agreement or transaction is between the relevant parties.
HDD Heroes is not responsible for the acts, omissions, performance, products, services or failure of independent third parties.
6. User-Submitted Content
Users may submit photographs, videos, stories, comments, jobsite material, company information or other content.
By submitting content, you confirm that:
you have the necessary rights to submit it;
you have obtained any necessary permissions;
it does not unlawfully infringe another person's rights;
it is not unlawful or defamatory; and
it is not intentionally false or misleading.
Where content is submitted for publication or promotion, you grant HDD Heroes a non-exclusive, worldwide, royalty-free licence to reproduce, display, publish and promote that content through the HDD Heroes website, social-media channels and related promotional material.
Ownership of the original content remains with its owner.
7. Intellectual Property
Unless otherwise stated, the following are owned by or licensed to HDDHEROES S.R.L.:
the HDD Heroes name;
logos;
graphics;
original photographs;
website designs;
written content;
artwork;
merchandise designs; and
other original materials.
These materials may not be reproduced, distributed or commercially used without prior written permission.
Third-party trademarks, logos and intellectual property remain the property of their respective owners.
8. Merchandise , Purchases and Orders
All prices are displayed in EURO and they include VAT. Shipping is included for EU deliveries only. For the sales inside Romania the price will be calculated in RON at the exchange rate of the BNR at the date of issuing the invoice.
Every order made on the site www.hddheroes.com will be considered as a sale contract.
For every purchase/order the company HDDHEROES SRL as a seller/reseller will issue an invoice what needs to be paid in the terms indicated on the invoice. Each invoice will contain a serial number. When the payment is made the invoice number and series needs to be mentioned on the payment document.
No cash payments are permitted. All the payments are made after the invoice will be issued and will be made by credit/debit card or by wire to our bank account mentioned on the invoice.
Where HDD Heroes offers merchandise or other products for sale, relevant product descriptions, prices and delivery charges will be displayed before an order is completed.
Orders remain subject to availability and acceptance.
HDD Heroes may cancel and refund an order where:
a product is unavailable;
an obvious pricing or technical error has occurred;
payment cannot be authorized;
fraudulent activity is suspected; or
fulfilment is not reasonably possible.
Custom-Made and Personalized Orders
Products that are:
made specifically for an individual customer;
personalized;
customized;
printed or manufactured to a customer's specifications;
made in a unique size, color, design or configuration requested by the customer; or
otherwise uniquely produced for that particular customer
cannot normally be returned, exchanged or refunded simply because the customer changes their mind.
Once production, printing, manufacturing or personalization of a custom order has started, the order may no longer be cancelled.
The customer is responsible for checking and approving any specifications, sizes, artwork, logos, text, colors or other information supplied to HDD Heroes before production begins.
This restriction does not affect the customer's legal rights where a custom-made or personalized product is:
defective;
damaged;
incorrectly produced;
materially different from the approved specifications; or
otherwise legally non-conforming.
Nothing in these Terms limits mandatory consumer rights under Romanian or European Union law.
9. Taxes, Customs and Import Duties
International orders, prizes and shipments may be subject to:
import VAT;
customs duties;
import taxes;
customs-clearance charges;
brokerage charges;
carrier charges; or
similar taxes or fees imposed by the destination country.
Unless expressly stated as included, or unless applicable law requires HDD Heroes to collect, withhold or pay such amounts, all taxes, customs duties and associated charges are the responsibility of the purchaser, recipient or prize winner.
HDD Heroes is not responsible for additional import charges imposed by authorities in the destination country.
HDD Heroes is also not responsible for delays caused by customs authorities or customs-clearance procedures.
10. Competitions and Giveaways
Competitions and giveaways organized by HDD Heroes are subject to our separate Giveaway & Competition Terms, together with any specific rules published for the relevant promotion.
11. External Websites
The HDD Heroes website may contain links to third-party websites.
HDD Heroes does not control these websites and is not responsible for their content, availability, security, products, services or privacy practices.
Users access third-party websites at their own discretion.
12. Website Availability
We aim to keep the website available and accurate but cannot guarantee uninterrupted or error-free operation.
HDD Heroes may modify, suspend, update or remove website features or content where reasonably necessary.
13. Limitation of Liability
To the maximum extent permitted by applicable law, HDD Heroes will not be liable for indirect or consequential losses resulting from:
reliance on general website information;
dealings with independent third parties;
temporary website interruptions;
inaccurate information supplied by third parties; or
circumstances outside our reasonable control.

We may also collect and subsequently process certain information regarding your behavior while visiting our website in order to personalize your online experience and provide you with offers tailored to your profile. You may request at any time that we delete certain information or close your account, and we will comply with these requests, subject to the retention of certain information even after the account is closed, in situations where applicable law or our legitimate interests require it.

How We Protect the Security of Your Personal Data
We are committed to ensuring the security of your personal data by implementing appropriate technical and organizational measures in accordance with industry standards. Given the nature of the products we provide, which involve manually customizing them with the information you provide (e.g., photos, images, text), in exceptional cases, there is a possibility that your data may inadvertently end up in the possession of a third party (e.g., a customer); in such a case, HDDHEROES will take all necessary measures to remedy the situation. Furthermore, if you find yourself in a situation where you mistakenly receive products personalized with third-party data (e.g., photos, images, text), you are required to promptly notify HDDHEROES (via email, by phone) and implement the measures indicated by the company to protect the interests of the parties involved (destruction or return of the products or data in question that do not belong to you). To protect your data, HDDHEROES constantly implements and updates internal procedures and work processes, as well as provides training to employees responsible for processing your products, in order to minimize the occurrence of such situations.
HDDHEROES takes all appropriate organizational measures to protect personal data against accidental or unlawful destruction, loss, alteration, disclosure, or unauthorized access, including:
1. Data is stored electronically in files that can be accessed only by authorized users of the company, who in turn access them using a username and password (the password is changed periodically). All users are required to maintain the confidentiality of the data to which they have access and to log out of the database at the end of each session. If one or more users are removed for various reasons, their access accounts are suspended.
2. Users may access personal data solely for the purpose of performing their job duties. To this end, the controller will establish access levels based on functionality (entry, processing, saving, etc.) and on the actions performed on personal data (such as writing, reading, etc.), as well as the procedures governing these access levels.
3. The platform and server where customers enter their data are secure. Computers will be installed in lockable rooms. If personal data appears on the screen and remains inactive for a certain period of time, as determined by the operator, the work session will automatically close.
4. Personal data may be printed only by users authorized to perform this operation and only for purposes required by applicable laws.
If online payment is available and the customer chooses to pay online for the orders, contract, and/or contracts, credit card data is processed exclusively on the servers of the credit card processor with which HDDHEROES has entered into a contract.
HDDHEROES does not request or store any information regarding the customer’s credit card(s).
The credit card processor authorized by HDDHEROES has the right to access or view any type of data or documents generated as a result of a placed order, a canceled order, a contract, a canceled contract, or a fulfilled contract, in order to investigate any transaction, if applicable.
Despite the measures taken to protect your personal data, please be aware that transmitting information over the Internet, in general, or through other public networks, is not completely secure, and there is a risk that the data may be viewed and used by unauthorized third parties. We cannot be held responsible for such vulnerabilities in systems that are not under our control.

Other rights that may be exercised within the limits provided by law: the right to data portability, the right to object to data processing, the right to object to automated decision-making, the right to submit requests to the competent authorities regarding the processing carried out by HDDHEROES, etc., the right to withdraw consent at any time for the processing of personal data where the legal basis for processing is the data subject’s consent.
7. Complaints: You have the right to file a complaint with the supervisory authority regarding the processing of your personal data.

4. GIVEAWAY & COMPETITION TERMS

These Terms apply to competitions and giveaways organised by:

Individual competitions may contain additional rules. Any additional rules displayed on the relevant giveaway page form part of these Terms.
1. Eligibility
Unless otherwise specified:
entrants must be at least 18 years old;
entry is free;
no purchase is necessary;
entrants must comply with the stated entry requirements; and
persons directly involved in organising the competition may be excluded.
HDD Heroes may restrict competitions to particular countries or territories.
2. Competition Period
Each competition will state its:
opening date;
closing date; and
closing time where applicable.
Entries received after the closing period will not be accepted.
3. How to Enter
Entry instructions will be displayed on the relevant competition page.
Entrants must follow those instructions for an entry to be valid.
Automated, fraudulent, manipulated or duplicate entries may be removed.
Providing deliberately false information may result in disqualification.
4. Social-Media Promotions
Where a competition is promoted through Facebook, Instagram or another social-media platform, the promotion is not sponsored, endorsed, administered by or associated with that platform unless expressly stated otherwise.
Actions prohibited under the rules of the relevant platform will not be required as a condition of entry.
Participants are welcome to voluntarily share HDD Heroes content.
5. Winner Selection
The method used to determine winners will be stated for each competition.
Winner selection may include:
judging against stated criteria;
a skill-based competition; or
a lawful random draw.
Where Romanian law requires additional procedures for a particular competition, HDD Heroes will apply the necessary competition-specific requirements.
6. Prizes
Prize details will be described in the relevant giveaway announcement.
Unless otherwise stated:
prizes cannot be exchanged for cash;
prizes cannot normally be transferred;
sizes, colours and other options may be subject to availability; and
HDD Heroes may substitute an unavailable prize with a reasonably equivalent prize where necessary.
7. Winner Notification
Winners may be contacted through:
email;
telephone; or
the social-media account used to enter.
Winners may be required to provide:
full name;
delivery address;
telephone number;
country; and
clothing size where relevant.
If a winner fails to respond within the stated period, an alternative winner may be selected where legally permitted.
8. Taxes, Customs and Import Duties
International prize shipments may be subject to:
import VAT;
customs duties;
local taxes;
customs-clearance charges;
brokerage fees; or
other destination-country charges.
Unless applicable law requires HDD Heroes to collect, withhold or pay such amounts, all taxes, customs duties and similar charges relating to receipt of a prize are the responsibility of the winner.
HDD Heroes is not responsible for customs delays.
If a prize is refused or returned because the winner does not pay legitimate import or customs charges, HDD Heroes is not required to repeatedly re-ship the prize unless required by law.
9. Prize Delivery
Winners are responsible for supplying complete and accurate delivery information.
HDD Heroes is not responsible for delivery failure caused by inaccurate information supplied by the winner.
10. Submitted Content
Where a competition involves photographs, videos, stories or other material, entrants confirm that they have the necessary rights and permissions to submit it.
11. Personal Information
Personal information collected through competitions and giveaways will be handled according to the HDD Heroes Privacy Policy.
Entering a competition does not automatically constitute consent to unrelated marketing.
12. Fraud and Abuse
HDD Heroes may disqualify entrants where there is reasonable evidence of:
fraudulent entry;
manipulation;
automated entry;
impersonation;
duplicate entries contrary to the rules;
deliberately false information; or
other abuse.
13. Cancellation or Modification
HDD Heroes may reasonably modify, postpone, suspend or cancel a promotion where circumstances outside its reasonable control make this necessary.
14. Limitation of Liability
To the maximum extent permitted by law, HDD Heroes is not responsible for:
lost or delayed entries;
third-party platform failures;
incorrect contact details;
courier delays;
customs delays; or
circumstances outside our reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded.
15. Governing Law
Competitions organised by HDDHEROES S.R.L. are governed by the laws of Romania, subject to mandatory rights applicable elsewhere.

5. SHIPPING, RETURNS & REFUNDS POLICY

2. Prices
Product prices will be displayed before purchase.
Where applicable, VAT will be handled according to applicable law.
Shipping charges and other charges imposed directly by HDD Heroes will be displayed before the order is confirmed.
3. Shipping
Available delivery methods and applicable shipping costs will be displayed during checkout.
Delivery times are estimates unless expressly guaranteed. Shipping within EU takes around 4 – 6 days after the order was confirmed. All the shipments will be sent by courier and an AWB will be sent to the customer when the parcel leaves our premises.
Outside EU the shipping time will be notified to the customer after the order has been placed as customs procedures and delay the shipment.
Delays may occur because of:
couriers;
customs;
public holidays;
weather;
transportation disruption;
strikes; or
circumstances outside the reasonable control of HDD Heroes.
4. International Taxes, Customs and Duties
International shipments may incur:

customs duties;
import taxes;
customs-clearance charges;
brokerage fees;
carrier fees; or
other destination-country charges.
Unless expressly included in the purchase price, or unless applicable law requires HDD Heroes to collect or pay them, these charges are the responsibility of the customer or recipient.
HDD Heroes has no control over charges imposed by foreign customs or tax authorities.
Customers are responsible for checking local import requirements.
5. Right of Withdrawal
Where Romanian or European Union consumer law provides a statutory right of withdrawal, a consumer may withdraw from an eligible distance purchase within the applicable statutory period, normally 14 calendar days.
The customer must notify HDD Heroes within the applicable period.
6. Custom-Made, Personalized and Unique Products
According to OUG 130/2000 the standard change-of-mind withdrawal and return right does not normally apply to goods made according to a customer's specifications or clearly personalized
This includes products:
specially manufactured for a particular customer;
printed with a customer's logo or branding;
produced using artwork supplied or approved by the customer;
made in unique sizes or configurations;
personalized with names, text or images; or
otherwise specially created for a particular customer's order.
These products cannot normally be returned, exchanged or refunded simply because the customer changes their mind.
Once production, manufacturing, printing or personalization has started, cancellation may no longer be possible.
The customer is responsible for checking and approving any specifications, designs, spelling, dimensions, colours, artwork or other details before production begins.
This restriction does not apply where the product is:
defective;
damaged;
incorrectly manufactured;
materially different from the agreed or approved specification; or
otherwise legally non-conforming.
Mandatory legal rights remain unaffected.
7. Returning Standard Products
Following a valid withdrawal notification for an eligible standard product, the goods must be returned within the applicable statutory period (14 days from the date of receiving the goods).
Customers may inspect the goods only as reasonably necessary to determine their nature, characteristics and functioning.
The customer may be responsible for diminished value resulting from excessive handling.
If the clients want the goods to be replaced with a new product (like the one that was ordered) a new product will be sent if this is in stock. If the product is not in stock anymore a similar product can be sent if agreed by the customer. The shipment within Europe takes 4-6 working days.
8. Return Shipping Costs
For a normal change-of-mind return, the direct cost of returning eligible goods is normally the customer's responsibility where permitted by law ( maximum 14 days after receiving the goods).
Where goods are faulty, incorrect, damaged or legally non-conforming, return costs will be handled according to applicable consumer law.
9. Refunds
Where a customer validly exercises a statutory right of withdrawal, HDD Heroes will process the required refund within the period prescribed by law.
Where several delivery methods were offered and the customer selected a more expensive method, HDD Heroes may limit reimbursement of the original delivery charge to the least expensive standard delivery option where permitted by law.
HDD Heroes may withhold reimbursement until:
the returned goods have been received; or
appropriate evidence of return has been supplied,
where legally permitted.
10. Faulty, Damaged or Incorrect Goods
If you receive a product that is:
damaged;
defective;
incorrect; or
otherwise non-conforming,
please contact HDD Heroes as soon as reasonably possible.
Please provide:
your name;
order number;
description of the issue; and
photographs where appropriate.
Mandatory consumer rights remain unaffected.
11. Incorrect Addresses and Unclaimed Parcels
Customers are responsible for providing complete and accurate delivery information.
Where an order is returned because:
an incorrect address was supplied;
delivery was refused;
the parcel was not collected; or
legitimate customs or import charges were not paid,
HDD Heroes may deduct reasonable costs associated with the failed delivery and return shipment from any refund where permitted by law.
12. Giveaway Prizes
Products supplied free of charge as competition or giveaway prizes are not consumer purchases.
Normal change-of-mind return rights applicable to purchases therefore do not apply to prizes in the same manner.
Where a prize arrives materially damaged or incorrect, the winner should contact HDD Heroes and we will reasonably attempt to resolve the issue.

This Policy is governed by the laws of Romania, together with applicable mandatory European Union consumer protections.
